1. Acceptance of Terms

By downloading, accessing, or using Pixlo (“the App”), you agree to be bound by these Terms of Service.

If you do not agree, do not use the App.

2. Description of Service

Pixlo provides AI-powered photo editing tools that allow users to:

• Upload images

• Apply visual edits

• Use templates

• Enter prompts

• Generate edited image outputs

AI-generated results may vary and may not always be accurate, realistic, complete, or suitable for your intended use.

3. Subscriptions, Credits, and Payments

a. Subscription Plans

Pixlo may offer auto-renewable subscriptions that provide access to premium features, credits, or other benefits.

b. Credits or Tokens

Pixlo may use credits or tokens to access certain editing or generation features.

Credits may be:

• Included with subscriptions

• Granted through promotions

• Purchased separately where available

Credits have no cash value, are not legal tender, and are not transferable.

Credits may be consumed when you request image generation or other paid app features.

c. Billing

Payment is charged to your Apple ID at confirmation of purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours prior to the end of the current period.

d. Managing Subscriptions

You can manage or cancel your subscription anytime in your Apple ID account settings.

e. Free Trials

Free trials, if offered, will automatically convert to a paid subscription unless canceled before the trial ends.

f. Refunds

Payments, refunds, and billing issues are handled by Apple through the App Store.

Apex Labs does not control Apple’s refund process.

4. User Content

You retain ownership of the photos, prompts, and other content you upload or submit to Pixlo (“User Content”).

You grant Apex Labs a limited, non-exclusive license to host, store, process, transmit, and display your User Content solely as needed to:

• Operate Pixlo

• Provide AI photo editing features

• Generate outputs

• Maintain your generation history

• Troubleshoot issues

• Improve service reliability

You are responsible for ensuring that you have the rights and permissions necessary to upload and process any content you submit.

5. AI Outputs

Pixlo may generate edited images or other outputs based on your uploaded content, selected templates, and prompts.

You are responsible for reviewing and using outputs appropriately.

We do not guarantee that outputs will be free from:

• Errors

• Artifacts

• Unintended changes

• Similarities to other content

You agree not to use Pixlo or generated outputs in a way that violates applicable law, third-party rights, or these Terms.

6. Acceptable Use

You agree not to:

• Use the App for unlawful, harmful, abusive, fraudulent, or deceptive purposes

• Upload or process content that violates the rights of others, including privacy, publicity, copyright, trademark, or other intellectual property rights

• Upload content you do not have permission to use

• Use the App to harass, exploit, impersonate, or harm another person

• Attempt to generate or distribute illegal, sexually exploitative, hateful, or non-consensual content

• Interfere with, disrupt, reverse engineer, scrape, or abuse the App or its systems

• Attempt to bypass subscriptions, credits, security measures, rate limits, or usage restrictions

7. Intellectual Property

The App, including its software, design, branding, templates, features, and technology, is owned by Apex Labs or its licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of the App or any Apex Labs intellectual property.

8. Account and Termination

You may stop using the App at any time.

You may delete your account from within the App settings where available.

We may suspend or terminate your access to the App if you:

• Violate these Terms

• Misuse the service

• Create risk for other users or Apex Labs

• Are subject to termination as required by law

9. Third-Party Services

Pixlo may rely on third-party services for:

• Authentication

• Payments

• Subscriptions

• Analytics

• Crash reporting

• Cloud storage

• Backend infrastructure

• AI processing

Your use of those third-party services may also be subject to their own terms and policies.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.

We do not guarantee that the App will be uninterrupted, secure, error-free, or that generated results will meet your expectations.

11. Limitation of Liability

To the fullest extent permitted by law, Apex Labs shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the App.

12. Changes to the App or Terms

We may update, modify, suspend, or discontinue parts of the App at any time.

We may update these Terms from time to time.

Continued use of the App after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law principles.

14. Apple Terms

This agreement is between you and Apex Labs, not Apple.

Apple is not responsible for the App or its content.

Your use of the App is also subject to Apple’s Standard End User License Agreement (EULA), available at:
